Resident Association of VIRUPAKSHPURA has BUSTED CORRUPTION RACKET using RTI Act 2005

Once again  i  (K N Jagadish kumar From Residenta association of Virupakshapura) of ward 14 & 15 CMC Byatrayanapura.

Recently one sensational act took place in CMC Byatrayanapura.

The news is “recently a circular ( annual meeting agenda) was send to all 31 ward councillors about the meeting which is going to be held on 31/07/06. the meeting was fixed to decide the annual developments and also development works alloted to all different 31 wards. A copy of it i received under RTI 2005 act. All the 31 wards were given around Rs 25 lakh to Rs.30 lakhs of work for each ward except ward 14 & 15.

Ward 14 & 15 were given a works of totalling to Rs. 4 Crore( Four Crore). when i went through the file a total development works of Rs.16 Crore were finalised in that all the 31 wards.

For 29 wards Rs .12 Crore.

For ward (14& 15) Rs. 4 Crore.

There was huge difference between allocating the budget.

Our association is in ward 14 & 15.

When enquired the CMC – commissioner C K Daswanth, AEE – Gopalappa and JE -surendra they opened their mouth with a lot difficulty that the works were propsed by K N Chakrapani ( Ex- CMC Councillor and state General Secretary JD(S)).

When our Association cross checked the works proposed in Rs.  4 crore in the ward, most of the works( sub -standard) were already completed with out even calling the tender and after completing they ( commissioner, AEE .JE and K N chakrapni)  were planning to join these works in the current years budget?.

Now we have busted this racket?

K N Chakrapani is powerfulman and he is running a parallel governemnt in CMC by his vast power along with Devegowdaji?

Officials say that ,there were forced and thretned by chakrapni to execute such task.
If we raise this issue officilas will be taken into task but the real culprit chakrapni will be left free. if the officilas are taken into task and they are transferred or suspended ,this chakrapni will continue the same work with new officials also.

we are confused , please suggest.

can an `aggrieved’ pio file an appeal with the info commission?

Dear all ,
In this Particular case , the Aggrived is a trust (running a school) which states that it is aggrived as it has been treated an public authority . Since the Trust was Formed at the Pleasure of the Govt  and the School is being run upon obtaining permission of the Govt , Bound to submit certain data / Info/ Statements/ returns to the Govt , The consideration of the AA that this Trust is an public authority  must only be Countered in court of Law as to contrary .

An approach against the decesion to the Education dept/Secretary  will be an Administrative overruling of the AA and automatically the AA will step in as the PIO for such a trust ,since he is the authority monitoring the trust by way of insisting /studing /directing the trust through data/info/statement/returns desigined by the appropriate govt .

Karnataka Appeal Procedure rules under sec 27

Right to Information Act, 2005- Appeal Procedure, Rules under Section 27 of the Act.

No. DPAR 74 RTI 2005 (Part II) dated: 15- 7- 2006

In exercise of the powers conferred by sub- section (1) and (2) of section 27 of the Right to Information Act, 2005 (Central Act 22 of 2005), the Government of Karnataka hereby makes the following rules to amend the Karnataka Right to Information Rules, 2005, namely: –
1. Title and commencement: – These rules may be called the Karnataka Right to Information (Amendment) Rules, 2006.

(2) They shall come into force from the date of their publication in the Official Gazette.

2. Amendment of rule 7: – For rule 7 of the Karnataka Right to Information Rules, 2005 (hereinafter referred to as the said rules), the following shall be substituted, namely: –

“7. Appeal under sub- section (3) of section 19: – (1) an appeal to the State Information Commission under sub- section 19 shall contain the following information, namely: –
(i)                 Name and address of the appellant;
(ii)                Name and address of then State Public Information Officer against the decision of whom the appeal is preferred;
(iii)              Particularly of the order including number, if any, against which the appeal is preferred;
(iv)              Brief facts leading to the appeal
(v)               If the appeal is preferred against deemed refusal, the particulars of the application, including number and date and name and address of the State Public Information Officer to whom the application was made;
(vi)              Prayer or relief sought;
(vii)            Grounds for the prayer or relief;
(viii)           Verification by the appellant; and
(ix)              Any other information, which the commission may deem necessary for deciding the appeal.”
3.Insertion of new rules 8, 9, 10,11 and 12: – After rule 7 of the said rules, the following new rules shall be inserted, namely: –

“8. Documents to accompany appeal: – Every appeal made to the State Information Commission shall be in triplicate accompanied by the following documents, namely: –
(i)                 Self- attested copies of the Orders or documents against which the appeal is being preferred;
(ii)                Copies of documents relied upon by the appellant and referred to in the appeal; and
(iii)              An index of the documents referred to in the appeal;

4. Procedure in deciding appeal: – In deciding the appeal, the State Information Commission may: –
(i)                 Hear oral, or written evidence on oath or on affidavit from concerned or interested person;
(ii)                Peruse or inspect documents, public record or copies thereof;
(iii)              Inquire through authorized officer further details or facts;
(iv)              Hear State Public Information Officer, State Assistant Public Information Officer or such Senior Officer who decided the first appeal, or such person against whom the complaint is made, as the case may be;
(v)               Hear third party; and
(vi)              Receive evidence on affidavits from State Public Information Officer, State Assistant Public Information Officer, such other Senior Officer who decided the first appeal, or such person against whom the complaint lies or the third party.
5. Service of notice by Commission: – Notice to be issued by the State Information Commission may be served in any of the following modes, namely: –
(i)                 Service to the party itself;
(ii)                By hand delivery (dusty) through process server;
(iii)              By registered post with acknowledgement due; or
(iv)              Through Head of office or Department;
(v)               By fax;
(vi)              By e- mail.
6. Personal presence of the appellant or complaint: –
(1)    The appellant or the complaint, as the case may be, shall in every case be informed of the date of hearing at least ten clear days before that date.
(2)    The appellant or the complainant, as the case may be,  may at his discretion at the time of hearing of the appeal or complaint by the State Information Commission be present in person or through his duty authorized representative or may not be present.
(3)    Where the State Information Commission is satisfied that the circumstances exist due to which the appellant or the complaint, as the case may be, is being prevented from attending the hearing before the State Information Commission, then, the State Information Commission may afford the appellant or the complaint, as the case may be, another opportunity of being heard before a final decision is taken or take any other appropriate action as it may deem fit.
(4)    The appellant or the complaint, as the case may be, may seek the assistance of any person in the process of the appeal while presenting his points and the person representing him may not be a legal practitioner.
7. Order of the State Information Commission: – Order of the State Information Commission shall be in writing and be pronounced in open proceedings. Such order shall be duly authenticated by the Under Secretary or any other officer authorized by the State Information Commission for this purpose.”

Inspection of Files —— Peculiar case

Dear freinds ,
Today I was in the Info comm and the first case called was Mr V & Executive engineer Bescom .This case had already come up as Complaint and the Info Comm had ordered  Inspection of File . But when the Complainant (Mr v) went to the office of EE Bescom , he was directed to sign an acknowledgement of having seen the file and then only he would be handed over the file for inspection. Mr V was shrewed enough , he called Mr Veeresh our KRIA katte activist and President Brastachar Nirmoolana vedike . They immediatly drew an affidavit and submitted a further Complaint on the EE Bescom .
Today the Second Complaint came up and the EE Bescom (PIO) was very strongly repramanded by the SCIC for wasting time of everybody and ordered that the File Inspection to Mr V be allowed by 3 pm today and Both parties should file(PIO + Complainant) their report by tomorrow .
Now My question to all freinds , have you faced such suiations , will it be proper for us follow a uniform code for file inspections other wise , babu’s may try all their Madari tricks on Citizens .

Can an Advocate represent an PIO — when he is wrong

dear freinds ,
I was representing Mr Yaswanth Dalvi of Vadagoan Belgaum Today . I was asked to represent him by my freinds from belgaum . The Case was the PIO had not provided info sought within thirty days , the Requester had gone under appeal to the AA (DC of Belgaum) .
However both PIO and AA were represnted by an Advocate From Bangalore who tried to divert the entire issue in the Info comm . Finally  we could get an undated reply addressed to the info commission . We could also get these noted in orders of the commission.
Now my question is what will be the position of Commoners who are unrepresented when PIO’s start sending Advocates  as their duly authorised representatives . What if the PIO’s have committed the mistake of not having provided the info within 30 days and Deemed refusal , already there is a loss to govt thorugh loss by additional fees , and over that advocates fees .
Can we think of how to counter this

One more hurdle in procuring information from the government was eliminated on Thursday, after the Karnataka State Information Commission shifted its office out of Vidhana Soudha, into its new office at the MS Building (III Floor, Gate 1).

A year after the Right to Information Act was implemented in the State, the common man found it difficult to approach the Commission in Vidhana Soudha due to tight security. But now, the new office is not only people-friendly, it also has added a court room, where hearing will be held from Monday to Friday between 11.30 am and 3 pm.

“Despite initial reluctance to part with information, the government officials are forthcoming in disclosing information, except in cases where the information could hamper investigation. Some offices had denied information citing that records were lost. But they have been given a warning to maintain permanent records,” said Mr K K Misra, Chief Information Commissioner. The Annual report will give details of the number of applications received in each district, he added.

“In the last six months, the Commission has received 181 appeals, out of which 89 have been disposed of. Further, 151 of the 387 complaints were disposed of. A large number of complaints were related to urban development department, BMP, CMCs, BDA and co-operative housing societies,” said Mr K A Thippeswamy, State Information Commissioner.

For the first time in the state students have been given photocopies of their examination answer sheets, under the Right to Information Act (RTI Act).

This happened here on Friday when Pre-University Education Board Deputy Director Mahabaleshwar Bhat granted photocopies of answer sheets of students who had failed in first PU exams, in response to a request based on Right to Information Act. This development would go a long way in ensuring transparency in the examination process.

Mr Bhat, who handed over the answer sheets, admitted that the request for photocopies of answer sheets could not be turned down.

He explained that he had written to the PU Education Board director in Bangalore about the students’ request on June 30. But the students delayed to give an application in writing for 10 days. After the application was submitted, he had to wait another four days to hear from Bangalore. The director told him over phone to grant the photocopies and that written permission would be sent later by fax. Accordingly, Mr Bhat said that he had provided the answer sheets.

Bhat clarified that though photocopies of answer sheets could be given under the Right to Information Act, revaluation could be done only through guidelines laid by the PU Education Board.

The students got the photocopies thanks to advocacy by NSUI District President Raghu Naik and Dalit Sangharsh Samiti leader Elish G Yelakapati.
