The Information Commission has sent a notice to the Bharat Sanchar Nigam Limited for avoiding to provide information to a citizen from Bhopal by demanding exaggerated fees for the purpose.

Severely castigating the Public Sector telecommunication major for the way it treated the public request, the Commission has ordered it to make available all information sought charging only the amount specified under the Right to Information Act.

Complainant Kailash Mishra of Bhopal had applied to Public Information Officer(PIO), BSNL recently for some information about the projects completed by its Switching and Installation Wing in Bhopal circle.

BSNL asked him to deposit Rs 9810 which included Rs 9732 for the man hours utilized to collect the information to be supplied.

The first appellate authority to whom Mr Mishra applied on February 20, 2006 communicated to him on March 18 that the additional fee was justified.

Thereafter, he filed an appeal with this Commission, stating that as far as he knew all the information he had requested for was available at the circle office of the department at Bhopal.

After pursuing the provisions of Section 7 of the RTI Act and the fee rules prescribed thereunder, a bench comprising Dr. O.P.

Kejariwal and Dr. M.M. Ansari concluded that such action of the department was only a subterfuge for avoiding supply of information to the Appellant.

”Since all the information was available at one place, there was no reason for deployment of extra manpower for supplying the information.” It also regretted that the BSNL had not responded to the Appellant’s request for providing details of computation whereby the Department had arrived at the above figure.

The Commission ordered the Respondent to show all the files/records relating to the information asked for and provide the complainant copies of the documents he desired at the fee prescribed under the Act.

”There was no doubt in the Commission’s mind that calculating and demanding the fee from the applicant showed an utter disregard for the letter and spirit of the Act and was obviously a malafide attempt on the part of CPIO, BSNL for denial of information,” the Bench said.

The Commission directed the officer to explain within 15 days of the issue of this Order why the penalties envisaged in Section 20 of the RTI Act not be imposed upon him.

The matter is posted for hearing on July 11.

    RIGHT TO INFORMATION ACT HAS NOT IMPLIMENTED AND INFORMATION NOT GIVEN FROM BSNL OFFICE,MAHABUBNAGER DIST AND HYDERABAD CGM ALSO. TAKE ACTION ON BSNL MAHABUBNAGER AND CGM.HYDERABAD.

    BSNL people will give 99% wrong information. Information given by officer1 will be treated as wrong information by office2. They also will give wrong information. and this will be proved when we go to office3……..This is my personal experience..beware of BSNL people.Simply they will try to send the customer by giving some information.Thats all. Their idea is to send out the customer…not giving correct information

    BSNL GUJARAT -one of the APIO of circle office have replied and reject First appeal application u./s.19 without his power

  4. BSNL -Gujarat telephone lines in rural area remains dead for 10/15/30 days or more and no-one officials up to SSA level bother for attend the complaint or problem in GUJARAT.
